Illegal felling leads to highest-ever combined penalty of over £34,000

After a contractor was found guilty of unauthorised works across almost 600m³ of woodland, including illegal felling, two individuals face more than £34,000 in combined fines and related charges – plus a restocking notice has been issued, requiring the illegally felled trees to be replaced.
This record-breaking fine is the consequence of illegal felling that took place over January and February 2023.
Highest combined penalty
The combined penalty of over £34,000 is the highest ever secured by the Forestry Commission. A spokesperson reiterated the importance of landowners and contractors obtaining felling licenses.
The penalty was split between the landowner and contractor that felled the trees, with the penalties being £560 and £34,000, respectively.
Restocking Notice
A Restocking Notice was also issued, requiring the land to be replanted with trees in order to mitigate the damage that was caused. If a Restocking Notice is not complied with, the Forestry Commission can further enforcement through issuing an Enforcement Notice. Enforcement Notices require the land to be restocked and maintained for ten years, and non-compliance is a criminal offense with an unlimited fine. The Forestry Commission can also seek a court order to make sure the trees are replanted and the Restocking Notice is followed.
